This Privacy Policy describes how Hungry Horse Poker LLC ("Hungry Horse Poker," "we," "us," or "our") collects, uses, and discloses your personal information when you visit, use our services, or make a purchase from https://www.hungryhorsepoker.com/ (the "Site") or otherwise communicate with us (collectively, the "Services"). For purposes of this Privacy Policy, "you" and "your" means you as the user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use or access any of the Services.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on the Site, update the "Last updated" date, and take any other steps required by applicable law.

What Personal Information We Collect

The categories and specific types of personal information we collect depend on how you interact with our Site and use our Services.

Information You Provide Directly

  • Contact details: name, email address, phone number, mailing address.
  • Account information: username, password, security questions, account preferences.
  • Order and payment information: billing address, items purchased, payment confirmation, transaction history. Card details are entered directly into our payment processor (Stripe) and are not stored by us.
  • Profile and coaching information: information you choose to share during enrollment, on intake forms, in coaching sessions, or in our community channels (e.g., your poker experience, goals, hands you are reviewing).
  • Communications: messages you send to us through email, the Site, or our community channels, including any information you choose to include.
  • Submissions to forms: information you submit through Typeform or other forms on the Site, including responses to surveys, applications, or intake questionnaires.

Information Collected Automatically

When you visit the Site or use our Services, we and our service providers automatically collect certain information about your device and your interactions, including:

  • Device and browser information: device type, operating system, browser type and version, screen resolution, language settings.
  • Network information: IP address, internet service provider, approximate geographic location derived from IP.
  • Usage information: pages viewed, time spent, navigation paths, referring URL, search terms used to find the Site, links clicked, A/B test variants assigned to you.
  • Identifiers: cookies, pixel tags, mobile advertising identifiers, persistent tracking IDs stored in your browser's local storage.
  • Marketing identifiers: Facebook click identifiers (fbclid, _fbp, _fbc) and similar identifiers used for advertising attribution when you arrive from or interact with advertising platforms.

Information from Third Parties

We may receive information about you from third parties, including:

  • Payment processors (e.g., Stripe) confirm your payment and provide limited information about the transaction.
  • CRM and marketing platforms (e.g., HubSpot) provide information about your interactions with our marketing and how you came to find us.
  • Advertising and analytics partners provide information about how you interact with our advertising and the websites where our advertising appears.
  • Course and membership platforms (e.g., Kajabi) provide information about your account, course progress, and platform interactions.

How We Use Your Personal Information

  • Providing and improving the Services. To create and manage your account, process payments, deliver coaching content and live sessions, provide customer support, send service communications, and improve our offerings.
  • Marketing and advertising. To send you marketing communications about our Services, to show you relevant advertising on our Site and on third-party platforms, to measure the effectiveness of our advertising, and to build audiences for similar prospects.
  • Analytics. To understand how visitors and members use the Services, identify trends, measure conversion, run A/B tests, and improve the user experience.
  • Security and fraud prevention. To detect, investigate, and prevent fraudulent, unauthorized, or illegal activity, and to protect the security of our Services and our users.
  • Legal compliance. To comply with applicable law, respond to lawful requests from public authorities, enforce our Terms of Service, and protect our rights and the rights of others.

How We Disclose Personal Information

We disclose personal information to the categories of recipients described below. We do not sell your personal information for money. However, some of our advertising and analytics practices may qualify as "sharing" or "selling" under California law, as described in the Your California Privacy Rights section below. You may opt out of those practices at any time.

Service Providers and Processors

We use the following third-party service providers and processors. Each of them processes personal information on our behalf or in connection with services they provide to us. We have summarized the categories of information shared and the purpose of the disclosure.

We may also disclose personal information to additional service providers that perform functions on our behalf such as IT management, cloud storage, customer support, fulfillment, fraud prevention, and analytics, where the disclosure is necessary for the provider to perform those functions.

HHP's Own Tracking and Analytics Infrastructure

In addition to the third-party tools listed above, we operate our own attribution and analytics service. When you visit the Site, our service stores a persistent identifier in your browser's local storage, captures information about your visit (URLs, referring source, A/B test variant, marketing identifiers), and sends that information to our backend hosted on Google Cloud Run. We store session and event data in Google Firestore, and we use Google BigQuery for aggregate analytics. We retain this information as described in Data Retention below.

We are the data controller for the information processed by our own infrastructure, and Google acts as our processor for the underlying cloud services.

Other Disclosures

  • In connection with a corporate transaction such as a merger, acquisition, financing, reorganization, or sale of assets, in which case personal information may be transferred as part of the transaction.
  • To comply with legal obligations or respond to lawful requests from public authorities, including subpoenas, court orders, and similar legal process.
  • To enforce our agreements and to protect the rights, property, or safety of Hungry Horse Poker, our users, or others.
  • With your consent or at your direction, including when you choose to share information through social media features or third-party integrations.

Cookies and Tracking Technologies

We and our service providers use cookies, pixel tags, web beacons, software development kits, and similar technologies (collectively, "cookies") to operate the Site, remember your preferences, deliver advertising, and measure how visitors interact with the Services.

The cookies we use fall into the following categories:

  • Strictly necessary cookies that are required for the Site to function (for example, to keep you logged in or remember your cart).
  • Analytics cookies that help us understand how the Site is used (for example, Google Analytics 4 and our own attribution service).
  • Advertising and conversion cookies used to deliver, measure, and optimize advertising on third-party platforms (for example, the Meta Pixel and similar tools).
  • Functional cookies that remember choices you make to provide a more personalized experience.

You can opt out of cookies that qualify as "sharing" or "selling" under California law as described below. Most browsers also let you remove or reject cookies through your browser settings. Removing or blocking cookies may affect your experience and may cause some Services to work incorrectly.

Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (as amended) gives you the rights described in this section. Some of these rights are also available to residents of other states with similar laws.

Right to Opt Out of "Sale" or "Sharing"

We disclose certain personal information to advertising and analytics partners (including Meta and Google) in ways that may qualify as a "sale" or "sharing" of personal information under California law. You have the right to opt out of these disclosures at any time. There is no charge to opt out, and opting out does not affect your access to our Services.

You can opt out in any of the following ways:

  • Use our opt-out page. Visit https://www.hungryhorsepoker.com/do-not-sell to set your preference. We will record your choice in a cookie on your browser and stop sharing your information with our advertising and analytics partners from that browser.
  • Use the Global Privacy Control (GPC). If your browser sends a Global Privacy Control signal, we treat that signal as a valid opt-out request for the browser that sent it. You do not need to do anything else.
  • Email us. Send a request to help@hungryhorsepoker.com with the subject line "Do Not Sell or Share" and we will process your request.

When you opt out, we stop loading the Meta Pixel for you, we stop sending conversion events about you to Meta through the Meta Conversions API, and we stop sharing identifiers about you with our advertising partners. Our own first-party analytics may continue to operate so that we can run the Site, and you may still see advertising โ€” it just will not be personalized based on your activity on our Site.

Because cookie-based opt-outs are tied to a specific browser and device, you will need to opt out separately on each browser and device you use, unless you use a browser-level signal like Global Privacy Control.

Other Rights

You also have the following rights, subject to verification of your identity and certain exceptions provided by law:

  • Right to know. You can request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collecting or sharing it, and the categories of third parties with whom we share it.
  • Right to delete. You can request that we delete personal information we have collected from you, subject to legal exceptions.
  • Right to correct. You can request that we correct inaccurate personal information we maintain about you.
  • Right to limit the use of sensitive personal information. You can request that we limit our use of sensitive personal information to purposes specified by law. We do not currently use sensitive personal information for purposes beyond those allowed without your consent.
  • Right to non-discrimination. We will not discriminate against you for exercising any of these rights.

To exercise these rights, email help@hungryhorsepoker.com with the request and the email address associated with your account. We may need to verify your identity before responding. You may also designate an authorized agent to make a request on your behalf, in which case we will require proof of authorization. We will respond within the time required by applicable law.

If we deny your request, you may appeal our decision by replying to our denial.

Data Retention

We retain personal information only for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Specifically:

  • Account data is retained for the life of your account and for a reasonable period afterward to allow you to reactivate your account, resolve disputes, and meet our recordkeeping obligations.
  • Tracking sessions stored in our backend (Google Firestore) are automatically deleted 90 days after creation.
  • Tracking links that associate email addresses with visitor session identifiers are automatically deleted 90 days after the most recent linkage event.
  • Payment data is retained by Stripe according to its retention practices and as required by tax and accounting law.
  • CRM data stored in HubSpot is retained while you remain a customer or prospect, and afterward subject to HubSpot's retention practices and our legitimate interests.
  • Live coaching session recordings are retained indefinitely and are made available to current and future members through our member library, as described in our Terms of Service.
  • Logs and analytics are retained according to the practices of the underlying systems (for example, Google Cloud Logging defaults), generally between 30 days and 13 months.
  • Communications and support records are retained as long as necessary to respond to your inquiry and afterward for a reasonable period to support our business operations.

After the applicable retention period, we delete or de-identify personal information unless we are required to retain it for legal or regulatory reasons.

Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. No security measures are perfect, and we cannot guarantee the absolute security of any information you transmit to us. We recommend that you do not use unsecured channels to send sensitive or confidential information to us.

Children's Privacy

The Services are not directed to children under the age of 16, and we do not knowingly collect personal information from children. As of the date of this Privacy Policy, we do not have actual knowledge that we sell or share the personal information of individuals under 16. If you are a parent or guardian and you believe a child has provided personal information to us, please contact us so we can delete it.

International Users

We are based in the United States, and we store and process personal information in the United States and in other countries where our service providers operate. If you access the Services from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States and other jurisdictions that may have data protection laws different from those in your country.

Third-Party Sites

The Services may contain links to websites and platforms operated by third parties. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policies of any third-party sites you visit.
